We recently did a project for another flooring contractor, who we had worked with in the past. Nearly 3 months have gone by and the guy has given me every excuse in the book and now is completely blowing me off about our payment. We did not have a contract, as it was done with only a days notice to sort of save his butt. Also, as I mentioned we had done work for him in the past with no issues, so I didn't think it was necessary. I now know that I need a contract no matter what. Anyway, can I file a lien against this property still? I have emails with proof that we did the job and it was done well. Also, I just noticed the house is for sale, so I need to get on this asap. Any help will be appreciated.

guess you learn who your friends are real quick when it comes to money..

i don't think you can lien if your laws are similar to NJ..there is a 90 day clause which means you have to
get the ball rolling by 60 days with proper notice and filings.

you can try sending a letter with your intent to the homeowners..it may shake them enough to do 1 of a few things..
Pay you

contact the other contractor demand payment to you..(which means nothing) but could be good if they were holding anything back.

I did this once when I got screwed on a job..

sent the letter to the HO letting them know My intent to lein and satisfy the debt.


they contacted me right away..they even called their lawyer who told them to pay me..

the guy questioned my character and said why don't you go after him?

I said he's your dog..and he bit me...(besides,how do I know you didn't screw him,I want my money)

one thing you need to learn in this biz..it is very easy to NOT pay someone in this biz..especially biz to biz..

Out here..If you don't have a contract, and don't file intent within 30 days of your last day on the job, your SOL.

Thanks for your replies. I think that is pretty much how it goes here as well. A good friend of mine has put me in touch with an attorney and I am thinking I might be past the deadline for a lien anyway. However, I think I can sue for the money owed. So I think that's what I am going to have to do. THanks again

Typically you must lein the home within a timeline immediately after completed. Up here in Alberta you must lein within 45 days after completion.
