A few days before the movers arrived to our new home, I decided that the floors needed buffing. A repair was needed and I felt the only way to properly do it was to do it all at one time. A highly recommended floor refinisher used an orbital sander and (not sure of the proper term) sanded the finish somewhat. The stain was still there but had been roughed up. Then more stain was applied. The same day the first coat of Lenmar oil based poly was applied. The second day it was screened then another coat applied. It then cured for two days before movers came.
When the movers unpacked boxes, some of the packing tape stuck to the floor and pulled the finish off in several places. I tried another type of tape and it did the same thing. The floor did not seem to suffer any other damage from loading heavy furniture that we can tell at this time.
The main question is: who is liable for the damage to the floor, if anyone.
1. The refinsher who perhaps performed the job improperly (notwithstanding the very sloppy repair job). Was an error made by not taking the floor to the bare wood? Not allowing the stain to dry properly?
2. The movers, though being warned to be very careful, allowed packing tape to pull up the finish?
3. Me, for being an idiot having floors refinished so close to moving in.
I am also able to, with my fingernail, continue to scrape up the finish on the areas that were pulled up by the tape.
